সাকিবের সাজাও কি আইন লঙ্ঘন করে

আইসিসি সাকিবের বিরুদ্ধে তদন্ত কমিটি ২০১৯ সালের ২৩ জানুয়ারি ও ২৭ আগস্ট সাকিবকে জিজ্ঞাসাবাদ করে। আর সাজা এল এমন এক সময়ে, যখন পদ্মা-মেঘনা-যমুনায় অনেক জল গড়িয়ে গেছে। রহস্যের গন্ধ সেখানেই।
আইসিসি যে Anti-Corruption Code এর যে বিধান লঙ্ঘনের জন্য সাকিবকে সাজা দিয়েছে তা কার্যকর হয়েছে ২০১৮ সালের ৯ ফেব্রুয়ারি থেকে। যা ICC Anti-Corruption Code এর ১১.৩ অনুচ্ছেদে উল্লেখ রয়েছে-
‘The Anti-Corruption Code shall come into full force and effect on 9 February 2018 (the “Effective Date”). It shall not operate to disturb any decisions and/or sanctions previously made under predecessor versions of the Anti-Corruption Code (including the Code of Conduct) or anti-corruption rules of National Cricket Federations. Nor shall its substantive provisions apply retrospectively to matters pending before the Effective Date. Instead, any case pending prior to the Effective Date, or brought after the Effective Date but based on acts or omissions that occurred before the Effective Date, shall be governed (a) as to substance, by the predecessor to the Anti-Corruption Code that was in force at the time of the alleged offence, subject to any application of the principle of lex mitior by the hearing panel determining the case; and (b) as to procedure, by this Anti-Corruption Code.’
অর্থাৎ এই কোড কার্যকরের তারিখের পূর্বের কোন ঘটনার ক্ষেত্রে ‘ retrospective effect’ বা ‘পেছনের দিকে কার্যকর’ প্রয়োগ করা যাবে না। তাই এই কোড কার্যকরের তারিখের পূর্বের ঘটনার জন্য বর্তমান কোডের অনুচ্ছেদ অনুযায়ী সাকিবকে সাজা প্রদান করা যাবে না।
সাকিবের বিরুদ্ধে আনীত অভিযোগের ঘটনার তারিখগুলো হলো, ১৯ জানুয়ারি ২০১৮, ২৩ জানুয়ারি ২০১৮ এবং ২৬ এপ্রিল ২০১৮। অর্থাৎ দুটি ঘটনা ICC Anti-Corruption Code এর কার্যকরের অর্থাৎ ২০১৮ সালের ৯ ফেব্রুয়ারির আগের। ফলে উক্ত দুটি ঘটনার ক্ষেত্রে এই কোড অনুযায়ী শাস্তি প্রদান সম্পুর্ন বেআইনী। কারণ, ১৯ জানুয়ারি ও ২৩ জানুয়ারির ঘটনার সময় ২০১৮ সালের ICC Anti-Corruption Code এর অনুচ্ছেদ ২.৪.৪ এবং ৬.২ এর কোন অস্তিত্বই ছিল না। ফলে উক্ত দুটি ঘটনার ক্ষেত্রে Code এর অনুচ্ছেদ ২.৪.৪ লঙ্ঘণের অপরাধে ৬.২ অনুচ্ছেদ অনুযায়ী সাকিবকে সাজা প্রদান সম্পুর্ন বেআইনী।
যদিও আইসিসির ২০১৪ সালের একটি ICC Anti-Corruption Code ছিল। তবে উক্ত কোডের অধীনেও কিন্তু সাকিবের বিরুদ্ধে কোনো ব্যবস্থা গ্রহণ করা হয়নি। যেহেতু বর্তমান কোড অনুযায়ী কেবল ২৬ এপ্রিলের ঘটনা প্রযোজ্য।
